Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User" or "you") and eSIM Turkey ("Company", "we", "us", or "our") and govern your use of our eSIM products, services, mobile application ("App"), and website ("Site").

These Terms become effective when you click "I Accept", create an account, download the App or any updates, access or use our services.

We may update these Terms from time to time. Changes will be effective upon posting to the Site. Your continued use of our services after such changes constitutes acceptance of the updated Terms.

eSIM Turkey is an eSIM platform operated by Check for Trips GmbH, based in Germany, providing services in Turkey. We offer digital SIM card services to domestic and international travelers in Turkey, reducing the need for physical SIM cards.

Our services include: Sale of eSIM data packages, eSIM activation and management services, Customer support, and Related telecommunications services.

To use our services, you must create an account. When creating an account, you agree to provide accurate and current information, keep your account information up to date, maintain the confidentiality of your login credentials, and be responsible for all activities under your account.

The Company reserves the right to reject any account, suspend accounts for suspicious activity, and terminate accounts for violation of these Terms.

Purchase and Activation: eSIMs and data packages are sold on a prepaid basis. Activation requires an eSIM-compatible and unlocked device. Activation period and usage conditions are specified in package details.

Usage Terms: All data plans are prepaid packages granting network access for the specified duration. No refunds for unused data within the package period. Packages are limited to the specified duration and quota. "Unlimited" packages are subject to fair usage policy. Daily data quotas do not roll over to the next day. Packages are personal and non-transferable.

⚠️ Important: Due to Türkiye's fair usage quota rule, your speed will be reduced to 1 Mbps after 5 GB of daily usage in unlimited packages.

Data Speed and Coverage: Data speed depends on local operator infrastructure and network conditions. 3G, 4G, 5G connectivity subject to network availability. No guarantee of specific speed or coverage.

Payment: Prices are in Euro (€) or US Dollar (USD) and include VAT. Payments processed through PayPal, Stripe, or other approved payment systems. Users are responsible for the accuracy of payment information.

Refund Policy: 14-day statutory right of withdrawal for non-activated eSIMs. Refunds processed only after service provider confirms eSIM deactivation. No refunds for activated or used eSIMs. Partial refunds possible for technical issues, subject to provider approval.

Users agree to: Use services only for lawful purposes, be solely responsible for account security and transactions, ensure device compatibility with eSIM technology, and maintain accurate and current information.

Prohibited Activities: Network or infrastructure damaging activities, fraudulent, illegal, or unauthorized use, service abuse or misuse, and violation of other users' rights.

The Company is not liable for: Service provider quality and interruptions, network coverage and connection speed, data loss, device incompatibility, force majeure events, and user error or negligence.

Liability Cap: Maximum liability limited to total eSIM package cost. No compensation for activated eSIMs. No liability for indirect damages or third-party claims.

These Terms are governed by the laws of the Federal Republic of Germany. For consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by laws of the consumer's country of residence.

Disputes: Courts of Frankfurt am Main, Germany have exclusive jurisdiction. Company reserves the right to file claims at user's place of residence. EU online dispute resolution platform available at https://ec.europa.eu/consumers/odr
